General Terms and Conditions (GTC)

These General Terms and Conditions (GTC) apply to all contracts between MY FITNESS CLUB (hereinafter "Provider") and the users of the website my-fitness-club.com regarding digital fitness and nutrition offers.

By registering or purchasing an offer, the user agrees to these GTC.

The exact scope of services results from the respective offer description on the website.

Registration is required to use certain content. The user undertakes to provide truthful information, to treat their access data confidentially and not to pass on their user account to third parties.

The provider is entitled to block or delete user accounts in the event of violations of these GTC.

The presentation of services on the website does not constitute a legally binding offer. The contract is concluded only when the user completes the ordering process and payment has been successfully made. The user then receives a confirmation by email.

The prices stated on the website at the time of the order apply. Payment is made via the offered payment methods. Access to paid content is generally only activated after successful receipt of payment.

All content provided is protected by copyright. The user receives a simple, non-transferable and non-exclusive right of use exclusively for private use. Reproduction, distribution or commercial use is prohibited.

The term and cancellation periods result from the respective product description. Cancellation can be made at any time via the user account or in writing by email.

The user expressly agrees that the provider begins providing the digital content before the withdrawal period expires. As a result, the right of withdrawal expires in accordance with § 18 (1) no. 11 FAGG upon commencement of access.

The training and nutrition programs offered serve exclusively for general fitness and health promotion and do not replace medical advice. Use is at your own responsibility.

The provider is liable only for intent and gross negligence. Liability for individual training successes or health improvements is excluded.

The provider endeavors to ensure the website is available as uninterrupted as possible. Maintenance work or technical faults may cause temporary restrictions.

The processing of personal data is carried out in accordance with the provider's privacy policy.

The provider reserves the right to adapt these GTC as needed. Registered users will be informed of significant changes.

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions remain unaffected.

The provider is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. The statutory regulation shall take their place.
